Sony Electronics Community Guidelines
By registering an account and/or accessing or using the Sony Electronics Community (hereinafter “we”, “us”, “our”, “Sony Community”, or “Community”), you agree to be legally bound by the following terms, in addition to any other terms governing this website, including the Privacy Policy, Website Terms of Use and:
ARBITRATION NOTICE: YOU AGREE THAT DISPUTES BETWEEN YOU AND SONY ELECTRONICS WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. WE EXPLAIN SOME EXCEPTIONS AND HOW YOU CAN OPT OUT OF ARBITRATION BELOW.
(Collectively, “Terms and Conditions”.)
If you do not agree to be legally bound by the Terms and Conditions, then please do not register for an account, access and/or use the Community.
As a user of the Community, you may have the ability to make information, data, text, graphics, images, sounds, videos, messages, links, profiles and other materials and content (collectively, “Content”) available through the Community. Content includes, but is not limited to, all comments, suggestions, advice, and ideas, including those made or given on Sony products and/or services.
Code of Conduct for the Community
Post your question to the appropriate board when possible.
Be clear and include important details (e.g., model number, error message, etc.) when you post a question.
Try to stay on topic when commenting.
Do not shout – avoid using ALL CAPS.
Do not include personally identifiable information (e.g., full name, address, email address, phone number, etc.) for yourself or others.
Be considerate and polite.
Be respectful – no cursing, swearing, insults or negative comments.
Support others in the Community.
Get support from others in the Community.
Do not litter the Community with irrelevant, inappropriate posts and/or SPAM.
Give kudos or thanks when others help you.
Learn and have fun!
Prohibited Practices
In the Sony Community, in addition to the Terms and Conditions, you are prohibited from engaging in any of the following:
Allowing another person to post on the Community on your behalf;
Deceptive or misleading practices;
Abusing, intimidating or harassing others and stalking behavior;
Doxing another person, or posting Content that includes another person’s private or personal information, including but not limited to Community profile information, images, personal phone numbers, email addresses, addresses, etc.;
Taking any action, uploading, posting, streaming or transmitting any Content, language, images or sounds in the Community that Sony, in its sole discretion, finds offensive, hateful or vulgar. This includes, but is not limited to, any Content or communication that Sony, in its sole discretion, deems to be racially, ethnically, religiously, or sexually offensive, libelous, defaming, threatening, bullying or stalking;
Organizing hate groups;
Uploading, posting, streaming or transmitting any Content that contains any viruses, worms, spyware, time bombs or other computer programs that may damage, interfere with or disrupt the Community or other users;
Uploading or linking any harmful or malicious technology, including malware, that unlawfully accesses information owned by Sony or a third party;
Causing disruption to the Community or any system, hardware, software or network connected to Sony websites;
Taking any action that Sony considers to be disruptive to the normal flow of chat or other activities in the Community, including, without limitation, uploading, posting, streaming or transmitting any unsolicited or unauthorized material, including junk mails, SPAM, excessive mails or chain letters;
Attempting to hack or reverse engineer any code or equipment in connection with Sony websites;
Making a false report of user abuse to Sony customer service;
Violating any local, state or national law;
Distributing commercial Content such as advertisements, solicitations, promotions and links to websites;
Uploading, posting, streaming, accessing or otherwise transmitting any Content that you know or should have known infringes or violates any third-party rights, any law or regulation or contractual or fiduciary obligations; and
Impersonating any person, including an employee or agent of Sony, its parent, subsidiaries or affiliates, or any third-party.
The views and opinions expressed by individuals within the Sony Community are solely those of the individuals themselves, and are not made or endorsed by Sony. Sony does not make any promises about the reliability of any source or the accuracy safety or intellectual property rights of any Content. The Community is provided as a convenient service to our customers and users to aid in their use of Sony products and services. The Community is not intended to be used for the promotion of third party (non-Sony) services, products, websites, or organizations, without Sony’s prior written approval. Please do not post Content or statements that would constitute advertising, junk mail, SPAM, chain letters, or any other form of communication or Content that seeks to solicit Community participants in any way. Such solicitation Content will be removed by Sony, and users posting such Content or communications may be permanently banned from the Community, at Sony’s sole discretion.
Sony’s Rights to User’s Content
Any Content or ideas submitted in the Community may be adapted, broadcast, changed, copied, disclosed, licensed, performed, posted, published, sold, transmitted, or used by Sony anywhere in the world, in any medium, forever. Further, Sony is free to use, without any review by you or compensation to you, any concepts, ideas, know-how, or techniques contained in any communication you post on or send to Sony or on the Community for any purpose whatsoever, including but not limited to enhancing, developing, manufacturing, and marketing products using such information. You agree and understand that Sony is not obligated to use any such ideas or materials, and you have no rights to compel such use.
Safeguard Your Account
You agree to exercise all reasonable efforts to keep your password and login information for the Community confidential. Further, you agree to promptly notify us if you become aware of or reasonably suspect any illegal or unauthorized activity or a security breach involving your account, including any loss, theft, or unauthorized disclosure or use of a username, password, or account.
Violating the Terms and Conditions and Moderating Use
You can help us keep the Community a friendly place by reporting violations, abuse and SPAMMING by sending an email to Sonycustomerrelations@sony.com.
Sony reserves the discretion to remove and alter any user’s Content on the Community at any time, with or without notice, for violation of the Terms and Conditions. Sony has the discretion to block users who violate the Terms and Conditions from posting and/or to terminate the user’s Community account.
Copyright Notice
If you believe that any Content has been copied in a way that constitutes copyright infringement, please forward the following information to the Copyright Agent at the address or email below:
Your name, address, telephone number, and email address;
A description of the copyrighted work that you claim has been infringed;
The exact URL or a description of where the alleged infringing material is located;
A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; and
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

By this notice, Sony seeks to preserve any and all exemptions from liability that may be available under the copyright law, but does not necessarily stipulate that it is a service provider as defined in 17 USC Section 512c or elsewhere in the law of the United States or any state or territory within the United States.
Disclaimer of Warranties
THE COMMUNITY AND ALL RELATED COMPONENTS AND INFORMATION ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. SONY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. USER ACKNOWLEDGES AND AGREES THAT SONY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR CONTINUOUSLY AVAILABLE.
Limitation of Liability
NEITHER SONY, NOR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE TO YOU OR ANY THIRD-PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO YOUR PARTICIPATION IN THE COMMUNITY, INCLUDING, WITHOUT LIMITATION, LOST REVENUE, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES HOWEVER CAUSED, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You will defend, indemnify and hold harmless Sony, its subsidiaries, affiliates, related entities and each of their officers, directors, employees, information providers, distributors, authorized retailers, licensors and licensees, and agents (collectively, “Indemnified Parties”), from and against any claim by a third party arising from or related to: (i) your use or attempted use of the Community in violation of the Terms and Conditions; (ii) your violation of any law or the rights of any third party; and/or (iii) any Content you post on the Community, including without limitation any claim of infringement, misappropriation, or violation of any intellectual property, privacy, or other rights.
Modifications to Terms and Conditions
Sony may add to, change, or remove any of the Terms and Conditions herein at any time, without notice. Any material revisions to the Terms and Conditions will become effective on the date we publish the change. Continued usage of the Community after changes to any of the terms, means you agree to be legally bound by the Terms and Conditions as they are revised, updated and/or amended.
Severability
The Terms and Conditions will be enforced to the fullest extent permitted under applicable law. If any provision of the Terms and Conditions is held by a court of competent jurisdiction to be contrary to law, the provision will be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of the Terms and Conditions will remain in full force and effect.
Governing Law; Venue
The Terms and Conditions constitute a binding agreement, and failure to comply with the Terms and Conditions may result in legal action. The Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without reference to its conflicts of law rules.
READ THE FOLLOWING DISPUTE RESOLUTION/ARBITRATION PROVISION CAREFULLY. IT DETAILS YOUR RIGHTS AND INSTRUCTIONS SHOULD A DISPUTE RELATED TO YOUR ACCOUNT, ACCESS AND/OR USE OF THE COMMUNITY.
Dispute Resolution (Including Binding Arbitration)
“Dispute” is defined as any disagreement, cause of action, claim, controversy, or proceeding between you and any Sony related to or arising out of your account, access and/or use of the Community, or the terms of this Agreement. Dispute is to be given the broadest possible meaning that will be enforced.
You and Sony agree that all Disputes shall be resolved exclusively through binding arbitration. YOU UNDERSTAND AND ACKNOWLEDGE THAT BY AGREEING TO ARBITRATION, YOU ARE GIVING UP THE RIGHT TO LITIGATE (OR PARTICIPATE IN AS A PARTY OR CLASS MEMBER) ANY DISPUTES IN COURT. You also agree that ANY DISPUTE RESOLUTION PROCEEDING WILL ONLY CONSIDER YOUR INDIVIDUAL CLAIMS, AND BOTH PARTIES AGREE NOT TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, REPRESENTATIVE ACTION, CONSOLIDATED ACTION, OR PRIVATE ATTORNEY GENERAL ACTION. Despite the above, you have the right to litigate any Dispute on an individual basis in small claims court or other similar court of limited jurisdiction, to the extent the amount at issue does not exceed $15,000, and as long as such court has proper jurisdiction and all other requirements (including amount in controversy) are satisfied.
If any part of this arbitration provision, other than waivers of class action rights, is deemed or found to be unenforceable for any reason, the remainder shall remain enforceable.
Arbitration Instructions. To begin Arbitration, either you or Sony must make a written demand to the other for arbitration. The Arbitration will take place before a single arbitrator. It will be administered in keeping with the Expedited Procedures of the Commercial Arbitration Rules, and the Supplementary Proceedings for Consumer-Related disputes when applicable (“Rules”) of the American Arbitration Association (“AAA”) in effect when the claim is filed. You may get a copy of AAA’s Rules by contacting AAA at (800) 778-7879 or visiting www.adr.org. The filing fees to begin and carry out arbitration will be shared between you and Sony, but in no event shall your fees ever exceed the amount allowable by the special rules for Consumers Disputes provided for by AAA, at which point Sony will cover all additional administrative fees and expenses. This does not prohibit the Arbitrator from giving the winning party their fees and expenses of the arbitration when appropriate pursuant to the Rules. Unless you and Sony agree differently, the arbitration will take place in the county and state where you live, and applicable federal or state law shall govern the substance of any Dispute during the arbitration. However, the Federal Arbitration Act, 9 U.S.C. § 1, et seq., will govern the arbitration itself and not any state law on arbitration. If you purchase the Product in the United States, but subsequently live outside of the United States, arbitration will take place in the county in which you purchased the Product. The Arbitrator’s decision will be binding and final, except for a limited right of appeal under the Federal Arbitration Act. The arbitrator may award declaratory or injunctive relief only to the extent necessary to provide relief warranted by that party’s individual claim, and any court with jurisdiction over the parties may enforce the arbitrator’s decision.
Opt-Out Instructions. IF YOU DO NOT WISH TO BE BOUND BY THE BINDING ARBITRATION PROVISION, THEN: (1) you must notify Sony in writing within 30 days of the date that the Website Terms of Use are posted on the Website; (2) your written notification must be mailed to Sony Electronics Inc., 16535 Via Esprillo, MZ 1105, San Diego CA 92127, Attn: Legal Department; AND (3) your written notification must include (a) your NAME, (b) your ADDRESS, (c) the DATE the Website Terms were posted on the Website, and (d) a clear statement that “YOU DO NOT WISH TO RESOLVE DISPUTES WITH ANY SONY ELECTRONICS ENTITY THROUGH ARBITRATION AND/OR BE BOUND BY THE CLASS ACTION WAIVER.”
Opting out of this dispute resolution procedure will not affect the coverage of the Limited Warranty in any way, and you will continue to enjoy the benefits of the Limited Warranty.
