1. SWEEPSTAKES TIMING:

These Official Rules apply to the Sony Alpha Universe YouTube Giveaway (“Sweepstakes”) being conducted by Sony Electronics Inc., 16535 Via Esprillo, San Diego, CA 92127 (“Sponsor”), and administered by Cohen-Friedberg Associates, LLC, Framingham, MA 01702 www.cfapromo.com (“Administrator”).  This Sweepstakes will consist of ten (10) unique monthly drawings (each a “Drawing Period”). Entry begins on Friday, January 7, 2022 at 12:01 a.m. Eastern Time (“ET”) and the last chance to enter is Monday, October 31, 2022 at 11:59:59 p.m. ET (the “Sweepstakes Period”). The Sweepstakes award one (1) prize in each Drawing Period (each a “Prize”). This Sweepstakes is Void where prohibited by law or regulatory order.

2. ELIGIBILITY:

This Sweepstakes IS Open to LEGAL RESIDENTS OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA AND LEGAL RESIDENTS OF CANADA (EXCLUDING RESIDENTS OF QUEBEC), WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER (or the age of majority in the state/PROVINCE or territory IN WHICH THE ENTRANT RESIDES at the time of entry (“you” or “your” or “Entrant”). Employees of Sponsor, its respective subsidiaries, affiliates, and advertising and promotion agencies, including Administrator, and their immediate families (spouse, parents, children and siblings and their respective spouses) and individuals living in the same households of such employees are ineligible to receive the Prize.

3. HOW TO ENTER:

You may enter by visiting the Sponsor’s Sweepstakes site at https://alphauniverse.com/ during the Sweepstakes Period.

Complete the online entry form with all required contact information, agree to the Official Rules, submit. After you submit click on the “Subscribe” button (it is free to subscribe) to complete the entry process.

All entries received prior to the applicable Drawing Period time set forth herein (see Rule #1 above) will be entered in to the relevant Drawing Period. No responsibility is assumed by Sponsor or the Administrator for lost, late, misdirected, illegible, incomplete, stolen, or mutilated entries or for any computer, online, telephone or technical malfunctions that may occur.

LIMIT: You may enter one (1) time per Drawing Period. LIMIT: One (1) Prize per person or household.

Entry Notes: You are supplying your information to the Sponsor and not to YouTube. YouTube is not a Sponsor of this Sweepstakes. The terms and conditions of YouTube use apply. Entrant will be able to review his or her entry prior to submission, but once any entry is submitted, Entrant cannot access/revise such entry in any way. Entries made on another’s behalf by any individuals or other entities, including but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified for the Sweepstakes. Tampering with the entry process or the operation of the Sweepstakes is prohibited and any entries deemed by Sponsor, in his sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.

Sponsor is not responsible for problems downloading or uploading any Sweepstakes-related information to or from the website or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in the Sweepstakes.

All entries become the property of Sony Electronics, Inc., and will not be acknowledged or returned. By entering into this Sweepstakes, you agree to Sponsor’s use of your personal information as described in the Sponsor’s web site privacy policy at https://electronics.sony.com/privacy-policy and in these Official Rules. In the event of any discrepancy between the privacy policy and these Official Rules, these Official Rules shall control and govern.

4. SWEEPSTAKES DRAWING:

Random drawings will be conducted based on the schedule listed in Rule #1 above by the Administrator, an independent organization, whose decisions are final and legally binding in all matters relating to this Sweepstakes. Entries will be declared made by the person who submitted the Entry. The odds of winning depend upon the total number of actual eligible entries received in the relevant Drawing Period. Should the winning entrant be from Canada, they will be required to first correctly answer a mathematical skill testing question without assistance of any kind (whether mechanical or otherwise) within a 2-minute time limit in order to be eligible to win prize. The question will be administered by phone or in a declaration within seven (7) business days following the drawing. If entrant cannot be contacted and the skill testing question administered, the prize will be forfeited and an alternate winner will be selected from the relevant Drawing Period.

Any and all warranties on any prize (if any) are subject to the respective manufacturers’ terms, and winner agrees to look solely to such manufacturers for any such warranty. Prize is non-transferable. Sponsor reserves the right to substitute a prize (or portion thereof) of equal or greater value if the advertised prize (or portion thereof) becomes unavailable. All ARV’s are subject to change based on, among other things, normal price fluctuations associated with the marketplace.

6. WINNERS LIST:

To receive the name of the Prize winner(s), send a self-addressed stamped envelope to: Sony Alpha Universe YouTube Giveaway Winners, P.O. Box 2274, Framingham, MA 01703-2274. Requests must be received no later than 11/21/22.

7. NOTIFICATION OF WINNER:

The Sweepstakes winner will be notified via email, Direct Message (DM) or by phone by the Administrator requesting confirmation of the Winner’s name and mailing address. The Winner is subject to verification. Potential winner will also be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release and W-9 taxpayer request for identification, within (7) calendar days of attempted notification to the Administrator. If a potential Winner fails to respond to any notification attempt within (7) calendar days, or if any attempted notification or Prize delivery is returned as undeliverable, or if a potential winner fails to complete and return any required Affidavit or Release within the specified time period, the potential winner may be disqualified and an alternate winner may be selected from the remaining Eligible Entries received in the relevant Drawing Period. In the liability release, the winner will agree to release Sponsor, Administrator, and its respective parent corporations, officers, directors, employees and stock holders from any injuries, damages or losses of any kind including death that may arise out of the participation in this Sweepstakes or out of the acceptance, use, misuse or possession of the Prize.

Once eligibility has been verified and the Administrator receives the prize Winner’s requested information, the Sponsor will arrange to award the Prize. Prize Winner must reply with all required information in order to receive their Prize.

By entering this Sweepstakes, you authorize Sponsor and its contractors to list your name and state on the Winners List, pending eligibility confirmation, should your entry be drawn. By entering this Sweepstakes, you agree to be bound by these Official Rules. The Official Rules are posted at https://alphauniverse.com. Acceptance of the Prize by the Winner constitutes permission by such person for Sponsor to use the Winner’s name, voice, likeness, and Prize won along with his or her address (city and state) and the right to use and publish their entries, proper name, and any statements made or attributed to such Winner (collectively, the “Attributes”) in any and all media, unless prohibited by law. This will include, but is not limited to, media now known or hereafter devised, without notice, review or approval, in perpetuity and throughout the world for advertising and promotional purposes in connection with this Sweepstakes without further consideration, compensation, and the Winner hereby releases Sponsor from any and all claims arising out of the use of such Attributes whatsoever.

8. GENERAL CONDITIONS:

All taxes, fees and surcharges on ANY prize won ARE the sole responsibility of the winner. You agree (i) to be bound by all applicable U.S. laws  and regulations, as well as these Official Rules and the decision of the Sponsor and Administrator, which are final and legally binding on all matters relating to the Sweepstakes, (ii) to waive any right to claim ambiguity in these Official Rules, and (iii) to release, indemnify and hold harmless Sponsor, and each of their respective affiliates, subsidiaries, agents, representatives, promotion and advertising agencies, including the Administrator, and their respective employees, officers, directors, shareholders and agents (collectively, “Releasees”) from and against any injuries, losses, damages, claims, actions any liability of any kind resulting from or arising from participation in this Sweepstakes or acceptance, possession, use, misuse or nonuse of any Prize that may be awarded.  Releasees are not responsible for printing or typographical errors in any Sweepstakes-related materials; for stolen, lost, late, misdirected, damaged, incomplete, inaccurate entries, or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including any injury or damage to you or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes, or inability to access any web site associated with this Sweepstakes, or process any transaction thereon.  If in the Sponsor’s sole opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of this Sweepstakes, the Administrator or Sponsor reserves the right at its sole discretion to disqualify any individual Administrator or Sponsor believes has tampered with the entry process and/or void any entries Administrator or Sponsor believes to have been submitted fraudulently, to modify or suspend this Sweepstakes, or to terminate this Sweepstakes and conduct a random drawing to award the Prize using all non-suspect entries received as of the termination date. Moreover, Sponsor reserves the right to rescind or change these Official Rules or this Sweepstakes at any time without notice unless otherwise prohibited by applicable law.  Any attempt by YOU or any other individual to deliberately damage any web site or undermine the legitimate operation of the promotion is a violation of criminal and civil laws and should such an attempt be made, SPONSOR reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.  Any attempts by an individual to access any web site associated with this Sweepstakes via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible.  Use of automated entry devices or programs such as by script, macro or any other automated means is prohibited and entries so generated are void. This Sweepstakes is conducted in English (which will be given its everyday ordinary meaning). By entering this Sweepstakes, you hereby agree that (a) any and all disputes shall be resolved in the appropriate state and federal courts in the State of California exclusively, and subject to the laws of the State of California (and should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California), (b) you irrevocably waive any objection, which any of them may now or hereafter have to the bringing of any such action or proceeding in such respective jurisdictions, including any objection to the laying of venue based on the grounds of forum non conveniences and any objection based on the grounds of lack of in personam jurisdiction, and (c) IN ANY LITIGATION ARISING FROM OR RELATED TO THIS sweepstakes, you HERETO and HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVE THE RIGHT you MAY HAVE TO A TRIAL BY JURY WITH RESPECT TO ANY LITIGATION BASED HEREON, OR ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS sweepstakes, OR ANY COURSE OF CONDUCT, COURSE OF DEALING, STATEMENTS (WHETHER ORAL OR WRITTEN) OR ACTIONS OF EITHER PARTY relating TO THIS sweepstakes. The failure of the Sponsor to enforce, insist upon, or comply with any of the terms, conditions or covenants of these Official Rules or the Sweepstakes, or Sponsor’s waiver of the same in any instance or instances shall not be construed as a general waiver or relinquishment of any such terms, conditions or covenants, but the same shall be and remain at all times in full force and effect. You acknowledge that you have carefully reviewed these Official Rules, that you have been advised with regard to the subject matter hereof by you legal counsel selected by you if you so choose to seek such counsel, and that these Official Rules and any uncertainty or ambiguity herein and therein shall not be construed against Sponsor as drafter. Should any provision, portion or application thereof, of these Official Rules be determined by a court of competent jurisdiction to be illegal, unenforceable or in conflict with any applicable laws, an equitable adjustment to the affected provisions of these Official Rules with a view toward effecting the purpose of these Official Rules and the validity and enforceability of the remaining provisions, portions or applications thereof, shall not be impaired.
