Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. ELIGIBILITY: The Sony Kando Sweepstakes described herein (“Sweepstakes”) is open only to the Sony Kando Everywhere event participants who are legal residents of the fifty (50) United States, the District of Columbia, and Canada (excluding Québec) who registered for the Sony Kando event and at the time of entry are at least eighteen (18) years of age and have reached the age of majority in their state or province of residence. Employees (and their immediate families, defined as spouse, parents, children, and siblings) of Sony Electronics Inc. (“Sponsor”) and its parents, subsidiaries, affiliates, suppliers, advertising agencies, The A Team L.L.C. (“Administrator”), and persons living in the same household as such employees are not eligible to participate in the Sweepstakes. Sweepstakes is void where prohibited by law. The Sweepstakes begins at 8:00:01 a.m. Pacific Time (“PT”) on August 15, 2020 (“Sweepstakes Entry Commencement”). Entries received prior to the Sweepstakes Entry Commencement will not be valid. All entries must be received by 3:30:59 p.m. PT on August 16, 2020 (“Sweepstakes Entry Deadline”).

2. HOW TO ENTER: There is one (1) method to enter the Sweepstakes. Each entrant must post a picture or video during the Sony Kando Event to their public Instagram account during the Sweepstakes Period. The post must be posted to the entrant’s public Instagram page. Instagram stories and IGTV posts will not be eligible for sweepstakes entry. Administrator’s computer will be the official timekeeper for the Sweepstakes. Accounts are free but subject to Instagram's Terms of Service (https://bit.ly/1FVji0P). Users must tag @sonyalpha and use both #SonyKandoEverywhere and #Sweepstakes in the caption of their submission photo/video.  You may enter as many times as you like, but each Submission must be unique, as determined by the Administrator at their discretion. Your account settings must be set to "unprotected" and/or "public" in order for your posts to be viewable by Sponsor and its agents.

If you post updates to or receive updates from Instagram via SMS from your wireless phone, message and data rates may apply. Posting content to Instagram requires a mobile device.  Message and Data rates may apply.  Please consult your wireless-service provider regarding its pricing plan.

3. ENTRY REQUIREMENTS AND RESTRICTIONS: Each photo must comply with the technical requirements for Instagram. All Submissions must be originally created by entrant. Entrant must have permission from all individuals who may appear in the Submission (if any) to use their names and likenesses in the Submission and to exercise the rights set forth herein. If requested, entrant must be able to provide such permissions in a form acceptable to Sponsor. Submissions must be relevant to the Sweepstakes. Additionally, failure of any Submission to comply with the below requirements and restrictions, as determined by Sponsor, in its sole discretion, may result in disqualification of entrant. Entries will not be acknowledged or returned. Entries must be suitable for presentation in a public forum, in the sole determination of Sponsor.

Entry containing any of the following may be disqualified:

• Violates or infringes another's rights, including without limitation, privacy, publicity or intellectual property rights, or that constitutes copyright infringement

• Contains material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age

• Contains any unacceptable clothing or adornments, or displays any commercial/corporate advertising other than that of Sponsor

• Contains indecent or unsafe behavior or situations, profanities or obscenities, including but not limited to nudity, or pornography, or is otherwise inappropriate, indecent, profane, obscene, hateful, tortuous, slanderous or libelous

• Contains or depicts someone smoking or intoxicated

• References persons or organizations without their written permission other than that of Sponsor

• Disparages or defames any persons or organizations including but not limited to Sponsor, Administrator or any other person or party affiliated with the Sweepstakes

• Includes threats to any person, place, business, or group

• Is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations

• Contains anything that is determined to damage or diminish the goodwill of the Released Parties, as determined by such entities solely in their respective discretion

• Does not comply with the terms or conditions or guidelines posted by Instagram (as applicable); or

• Is otherwise inappropriate, objectionable, or unsuitable for the uses contemplated in these Official Rules, including for presentation in a public forum, as determined by Sponsor in its sole discretion.

Entries using macro, robotic, script or other forms of automatic entry will be disqualified. Proof of submission does not constitute proof of receipt. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the email address associated with the social media account employed for entry. The "authorized account holder" is defined as the natural person to whom the email address is assigned by an Internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain. A potential winner may be asked to provide the Sponsor and/or Administrator with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible and an alternate winner may be selected. No responsibility is assumed for entries and winner notification responses that are lost, delayed, lost, misdirected, misdelivered, marked postage-due, illegible, mutilated, incorrect, or incomplete, and such entries will not be eligible for this Sweepstakes.

ODDS OF WINNING: Odds depend on the number of eligible Entries received for each drawing.

4. SELECTION OF PRIZE WINNERS: Prize Winners will be selected in random drawings per the chart below, from all eligible entries received during each Sweepstakes period. Each entry period begins and ends on the times/dates stated in the chart below.

Sweepstakes drawing will be conducted under the supervision of the Administrator, an independent judging organization. Winners will be notified by a Sony representative during the live Sony Kando event. A form email notification will follow on Monday, August 17th, 2020. If the notification Instagram direct message and follow up email is undeliverable or if winner does not respond to it within five (5) days of sending, he/she may be disqualified, and an alternate winner may be selected in his/her place. Any potential winner may be required to sign an affidavit of eligibility, a liability release and/or a publicity release. Failure to comply when requested may result in disqualification. Additionally, in order for a Canadian winner to be declared a winner, selected entrant(s) must correctly answer a time-limited mathematical skill-testing question to be administered by telephone at a mutually convenient time.

Prize winners shall be solely responsible for all federal, state and local taxes due as a result of receipt of prize. Prize may not be transferred, redeemed for cash, or substituted, except by Sponsor, who reserves the right to substitute a prize with another of comparable or greater value if the advertised prize becomes unavailable.

MISCELLANEOUS: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. Entrants found tampering with or abusing any aspect of this Sweepstakes will be disqualified. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Sweepstakes if any fraud, virus or other problem corrupts the administration, security, or proper play of the Sweepstakes as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award prizes at random from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor and Administrator are not responsible for lost, late, misdirected, garbled, illegible, incomplete, undelivered, or damaged entries and such entries will be void. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

Entering the Sweepstakes and accepting the prize constitutes permission to use the name and likeness of the prize winners for advertising and publicity purposes related to announcing the prize winners without further compensation, unless prohibited by law.

LIABILITY & RELEASE: By participating in the Sweepstakes, each entrant agrees to release and hold harmless Sponsor, Administrator and each of their respective parents, distributors, affiliates, subsidiaries, directors, officers, employees, sponsors and their advertising and promotional agencies (collectively, the “Sweepstakes Entities”) from and against any and all liability, injuries, loss, claim, damages, or cause of action arising out of participation in the Sweepstakes or receipt or use, misuse or possession of any prize, including, but not limited to: (a) human error or unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines (including but not limited to disruption related to Internet traffic, virus, bug or non-authorized intervention); (c) printing errors; (d) lost, late, misdirected, garbled, illegible, undelivered, or damaged entries, email, or mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons, including death, or property (including damage to entrant’s or any other person’s computer) which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt, use or misuse of any prize. Entrants hereby acknowledge that Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize.

DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
